These Terms of Use are effective as June 1, 2018. By accessing or using the Shop4Fun website, Shop4Fun service, and/or any applications, and/or content made available by Shop4Fun, Inc., (together, the “Service”) at www.shop4fun.ph, and all associated sites linked to www.shop4fun.ph, including all content and functionality available on the www.shop4fun.ph website (“Site”) however accessed, you agree to be bound by these Terms of Use. If you are successfully registered to Shop4Fun, you can buy various toys, action figures, collectibles, and branded merchandise items from different manufacturers and brands through the website and pay via various methods as provided to you on site, including but not limited to credit cards, bank fund transfers, and cash on delivery (hereafter known as “Payment Facility”). While there is currently no limit to the number of purchases which may be made per account per day, Shop4Fun reserves the right to impose such limits without prior notice. You acknowledge and agree that the form and nature of the Services, and the item manufacturers, distributors, and /or resellers Shop4Fun partners with may change from time to time without prior notice to you. You acknowledge and agree that Shop4Fun may permanently stop or suspend providing the Services (or any features thereof) to you or to users generally at Shop4Fun’s sole discretion, without prior notice to you, and that Shop4Fun can, for any reason and without prior notice, disable your account from accessing its Services anytime. Shop4Fun reserves the right to charge any fees (including applicable taxes) for use of Service and to change such prices anytime without prior notice. The materials on the Site with respect to products and services may be out of date, and Shop4Fun makes no commitment to update the materials on the Site with respect to such products and services.Your Use of the Site
You agree not to alter or modify any part of the website or Service. You agree that you will not incorporate any word or phrase in your name, Message ID or custom user-inputted information that is defamatory, obscene or profane, or which violates any trademark, service mark, or other proprietary/intellectual property rights of any third party, including, without limitation, that of Shop4Fun.* Sale and freely giving of access to the website or/and its related services and contents
* use of the website or/and its related services and contents for the primary purpose of, but not limited to, gaining from advertising, collecting subscriber profile bank, and earning from subscription revenue;
* and any use of the website or its related services that Shop4Fun finds, in its sole discretion, to use Shop4Fun’s resources or User Submissions with the effect of competing with or displacing the market for Shop4Fun, Shop4Fun content, or its User Submissions.
Shop4Fun reserves the right to discontinue any aspect of the Service of the Shop4Fun Website at any time. You agree not to use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Site or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site. Shop4Fun reserves the right to bar any such activity.Your Use of Content on the Site

* (C) the partner with whom Shop4Fun/Shop4Fun offered the Services to you has terminated its relationship with Shop4Fun/Shop4Fun or ceased to offer the Services to you; or
* (D) the provision of the Services to you by Shop4Fun/Shop4Fun is, in Shop4Fun/Shop4Fun’s opinion, no longer commercially viable.

You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by the laws of the Republic of the Philippines without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in the appropriate courts of Quezon City, Philippines, and waive any objection to such jurisdiction or venue. Any claim under these Terms of Use must be brought within one (1) year after the cause of action arises otherwise such claim or cause of action is barred. No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorneys’ fees. In the event of any controversy or dispute between Shop4Fun/Shop4Fun and you arising out of or in connection with your use of the Site, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.Void Where Prohibited

Although the Site is accessible worldwide, not all features, products or services discussed, referenced, provided or offered through or on the Site are available to all persons or in all geographic locations, or appropriate or available for use outside the Republic of the Philippines. Shop4Fun/Shop4Fun reserves the right to limit, in its sole discretion, the provision and quantity of any feature, product or service to any person or geographic area.
